General Terms and Conditions Appartements Ferchergasse by The Ranks GmbH

1. general

We rent out fully furnished apartments equipped with the usual utensils for the purpose of accommodating guests.

In case of doubt, the customer shall be deemed to be the guest, even if he has ordered or co-ordered for other persons.

The apartment rental price includes all additional costs such as electricity, water and heating. Bed linen and towels are included in the price.

Consumables (toilet paper, washing-up liquid, etc.) are in the apartment, food and spices are not available for hygiene reasons.

We do not offer breakfast or other meals.

Smoking is only permitted in the designated areas, smoking is prohibited in the apartments themselves. Pets are allowed on request for an additional charge.

2. booking conditions

2.1 Minimum stay

There is generally no minimum stay. However, it is possible to deviate from this at selected times.

2.2 Discounts and benefits

Discounts and benefits that apply in combination with tourist cards such as the Vienna City Card are subject to the respective conditions of the card. These conditions must be fulfilled at the time of booking and only apply to direct bookings at Appartements Ferchergasse.

2.3 Securing the booking

We only accept bookings that are guaranteed by the customer in one of the following ways:

  • By providing the card number, expiration date and name of the cardholder of a credit card valid at the time of arrival. By providing this information, the person making the booking expressly and irrevocably agrees that we will debit any cancellation fees from this credit card.
  • In exceptional cases by transferring an agreed down payment. The bank charges for the transfer shall be borne by the customer. In the event of a cancellation free of charge, Appartements Ferchergasse will refund the deposit minus a processing fee of € 20 to an account specified by the customer. The bank charges shall again be borne by the customer. In the event of a cancellation with costs or if the customer does not show up, the deposit is forfeited.

2.4 Cancellation conditions and fees

Cancellations and changes at least 14 days before the agreed arrival date are free of charge for stays of less than 20 days.

Cancellations and changes made less than 14 days before arrival will incur a cancellation fee equal to the total amount of the booked stay. If no deposit has been paid, the amount will be debited from the credit card provided by the customer at the time of booking.

For stays of more than 20 days and / or reservations of more than 2 apartments, the cancellation period is extended to 30 days before arrival. Cancellations and changes made less than 30 days before arrival will incur a cancellation fee of 30% of the total booked stay. If no deposit has been paid, the amount will be debited from the credit card provided by the customer at the time of booking.

If the customer does not appear at the agreed meeting point at the agreed time on the day of arrival – without contacting us in advance – the booking is deemed to have been canceled and the cancellation fee will be charged.

2.5 Early departure

If the guest announces that they will be leaving early, we will refund any overnight stays already paid for, provided that the actual departure date is announced at least 14 days in advance. We transfer the amount to an account specified by the guest, whereby the bank charges are borne by the customer, or pay the amount in cash at our office after making an appointment.

3. arrival and departure modalities

3.1 Arrival (check-in)

Check-in will be arranged with the guest, but we cannot guarantee that the apartment will be cleaned before 14:00.

We do not have a permanently manned reception and therefore ask you to let us know your arrival time so that we can welcome you, show you the apartment and hand over the keys.

3.2 Departure (check-out)

The apartment must be vacated by the guest by 11:00 am. We will charge an additional overnight stay if the check-out time is not met without a separate agreement.

4. payment

The apartment rent is due in full when the keys are handed over. For bookings of more than 2 months, payment can also be made monthly in advance.

Accepted payment methods

We accept:

  • Cash payment in Euro
  • Bank transfer in advance
  • Credit card

Under no circumstances do we accept checks or foreign currency.

5. regulations relating to the uninhabitability or unavailability of apartments

If it turns out that an apartment is not habitable or available due to defects, maintenance work or other operational requirements, we have the right to allocate the customer an apartment other than the one booked, provided that it is in the same location, is at least the same size and costs at least as much as the original apartment, whereby the price of the originally booked apartment will be charged.

If no such apartment is available, we will try to make the customer adequate alternative offers at reduced rates. The customer can select one of the alternative offers or cancel free of charge. In this case, Appartements Ferchergasse guarantees the reimbursement of all payments not consumed. Any further liability is excluded.

6 Obligations of the accommodation provider

6.1 Obligation to report

The Austrian Registration Act stipulates that every lodger must be registered with the police.

For this purpose, each guest must truthfully complete and sign a guest directory form provided for this purpose before using the apartment. Fellow travelers in the same apartment must also be recorded.

The guest’s personal data will be stored by us in accordance with the statutory period and will not be passed on to third parties – except to legally authorized persons. Each guest must ensure that only persons who have completed such a guest list stay in the apartment.

6.2 Other obligations

The guest must grant access to our staff or tradesmen commissioned by us at all times in order to carry out inspections, cleaning or repairs. We will of course ensure that the customer’s privacy is protected as far as possible and will give as much advance notice as possible.

The guest is obliged to treat the apartment and its furnishings and inventory with care as if it were his property. Under no circumstances is it permitted to use the apartments for purposes such as parties or events.

The guest shall bear all costs for the repair of damage caused willfully or by improper handling (e.g. traces of fire, damage or gross soiling of furniture/textiles, broken glass, etc.): Traces of fire, damage to or gross soiling of furniture/textiles, broken glass, etc.) in full.

If a key is lost, the guest must pay the cost of installing a new lock including 6 keys.

Guests are responsible for regularly disposing of their waste in the bins provided on the first floor of the building.

7. other

The apartment may not be sublet or rented to other persons.

We are not liable for theft, loss or damage to property or injuries and illnesses of the guest.

Any complaints or defects must be reported immediately so that we can arrange for the problem to be rectified as quickly as possible.

Lost property (items left behind) will be forwarded on request against reimbursement of costs. The retention period is 2 weeks.

If we transport the guest free of charge, liability is limited in accordance with the vehicle insurance for personal injury and property damage.

If the guest brings a car and parks it in a parking space (garage) provided by us, we accept no liability whatsoever for theft, damage or destruction.

8 General

We reserve the right to correct errors as well as printing and calculation errors. Verbal agreements shall only become effective if they are confirmed by us in writing. For any disputes arising from this contract and its fulfillment, as far as legally permissible, the competent court in Vienna, where the registered office of the accommodation is located, is agreed as the place of jurisdiction.

Should one of the above provisions be invalid, this shall not affect the validity of the other provisions. The invalid provision shall be replaced by a valid provision that comes as close as possible to it.
